This presentation will discuss recent developments at the federal and state level regarding regulation and caselaw associated with Per and polyfluoralkyl (PFAS) substances, for which there has been an increased focus by environmental regulatory agencies in connection with the potential human health and environmental impacts of these substances. The presentation will include discussion regarding the proposal by the EPA to regulate PFAS as hazardous substances under CERCLA, implications associated with conducting Phase I Environmental Site Assessments, caselaw in Wisconsin concerning PFAS regulation, recent regulatory PFAS standards adopted by the Wisconsin Department of Natural Resources (WDNR), and environmental agency proposals for future regulation of PFAS.
