Keeping Wisconsin Tort Law Weird:  Murphy v Columbus McKinnon and the Wisconsin Product Liability Statute

Presenter: Greg Heinen and Charlie Niemann, Foley & Lardner

This CLE presentation will cover the development of Wisconsin's 2011 product liability statute, why it was enacted and how it was intended to change Wisconsin tort law before 2011.  The presenters will also look at how Wisconsin courts began to apply the 2011 statute in pre-2022 cases, and describe exactly what the Wisconsin Supreme Court did in the Murphy case.  The program will conclude with a consideration of what this could mean for future product liability cases in Wisconsin, including by considering why Wisconsin tort law is often a little different than tort law in other states.
