Session Description
Employment litigation presents unique issues at mediation. The parties often have a long-term relationship that may or may not be continuing. Sometimes a friendly relationship has become adversarial and now involves significant business issues. Emotions almost always significantly influence the picture. And employment law has its own set of rules that make decisions sometimes riskier than in other areas of the law. Oftentimes, the complexity of the case results in disagreement on the facts, law and risk assessment.   
 
Lawyers who specialize in employment law from both the plaintiff and defense perspective, and ADR professionals who specialize in employment mediation, discuss the issues that need to be considered from the start of the dispute through the resolution and drafting of the settlement agreement.
