Session Summary In business, every decision is a business decision. That’s especially true in a business dispute. Unfortunately, sometimes the decision-making around dispute resolution gives way to emotional responses and is less efficient and more costly than it should be.
This session concentrates on approaching any business dispute from the proper perspective at the outset: Identify and evaluate the proper factors based upon the type and nature of the dispute, the persons involved and the business ramifications; and consider the proper use of ADR opportunities at the proper time and in the proper manner.
Business lawyers and litigators together with ADR professionals discuss the questions to ask and the considerations to make to take advantage of every opportunity to efficiently and timely resolve disputes and get back to business.
Session Key Take-Aways Attendees will learn the key questions to ask and areas to investigate when a dispute first arises, with appropriate consideration of the type and nature of the dispute, the parties involved and the business concerns that arise. Attendees will add to their resolution toolbox by learning when and how to evaluate early ADR options and learn how to set a framework for successful ADR. Attendees will gain knowledge of different ADR options to consider and use. Attendees will learn to “prepare to be creative” in resolution of business disputes while avoiding adverse business consequences and preserving important business relationships.
