Probate Seminar - Judgment and Bond Surcharges in Guardianship and Probate Cases

Part I: The first portion of this CLE will serve as a guide for probate/guardianship practitioners navigating bond surcharge issues: The presentation will cover the core mechanics of pursuing surcharge claims, highlighting how to develop a sufficient factual record and determine whether, when, and how to refer a matter for criminal review, with the goal of helping practitioners make informed decisions in both pursuing a bond surcharge and assessing referral options.

Part II: This portion will discuss the steps for making a referral to law enforcement, including what information to gather, where to refer, the types of potential crimes (e.g. theft and money laundering), the evidence used for prosecuting these crimes and how it is obtained, and the DA’s evaluation of whether to pursue charges (or not).
