This presentation will take a detailed look at Wisconsin’s economic loss doctrine, including its origins, its purpose, its scope, and its future. We will explain how the ELD is applied under current Wisconsin law, the exceptions to the ELD, and the effect of the application of the ELD in civil litigation. We will also take a brief look at how courts from around the country approach the doctrine and attempt to predict where the ELD may be headed in Wisconsin.
