Protecting Injured Employee’s Right to Counsel in Section 102.29 Claims

Under Section 102.29, both the employee’s and workers compensation carrier’s attorney’s fee and costs are to be considered in the reasonable cost of collection.  The presentation will focus on the existing legal standards, common practice, and the controversy resolved by the recent court of appeals’ decision, Sinkler v. American Family Ins.  The presentation will delve into the contingency fee customarily charged by employees’ counsel in such cases and the Sinkler court’s rejection of efforts to undermine those fee arrangements.
